Terms & Conditions
1. Australian Immigration Support Services (AUSISS) is owned by AUSISS Pty Ltd ACN 006 250 755.
2. AUSISS provides a vast and diverse range of services and support to assist people seeking to find information about relocating to Australia including Business, Housing. Lifestyle and Migration. AUSISS is NOT a licensed Immigration Agent. Where a client requires the services of an Immigration Agent, AUSISS will introduce the client to a registered Australian Immigration Agent.
3. AUSISS will provide the support and services listed in the "Exploratory Trip Program". AUSISS will at all times use its best endeavors to provide the most accurate information available.
4. You understand that the AUSISS service is provided in conjunction with its partners, but that AUSISS is totally independent of all other parties and takes no responsibility for any partner services or advice.
5. You agree not to provide any intentionally false or misleading statements seeking to unfairly manipulate the AUSISS service.
6. You understand and agree that you, your associates, your family or any other person availing themselves of the AUSISS service with you, will not hold AUSISS and / or its owners liable for any injuries, insurance claims, expectations, financial losses, costs, any information given or not given, or any other service or support perceived or otherwise before, during or after accepting any of the AUSISS service packages.
7. You understand and agree that AUSISS and / or its owners will not be held responsible for the integrity and honesty of any independent third party operator.
8. You understand that Ausiss Pty Ltd reserves the right to change the content of any information provided, along with these Terms & Conditions from time to time in the best interests of improving the AUSISS service on behalf of all clients, or as they see fit.
9. You understand and agree that where the client performs any action contrary to these terms & conditions, or performs or causes any action which in the opinion of AUSISS has detrimental effect on AUSISS and / or its integrity, AUSISS can withdraw all services and support at any time without any refund to the client.
10. You agree to provide AUSISS with accurate information and you understand that it is your responsibility to inform AUSISS of any changes to that information (including in particular your e-mail address)
11. You are responsible for all use of the AUSISS website either by you, or anyone else using your user name, identity or password/s. If you believe there has been any breach of security such as disclosure, unauthorized use of your login details, or any payment information, you must notify AUSISS immediately by e-mail.
12. You understand the cost of the AUSISS Exploratory Trip Package is non-refundable.
You agree to the following payment terms;
(a) Payments are due and payable as stated in the AUSISS Pty Ltd Fee Schedule.
(b) Cheques are NOT an accepted form of payment.
(c) You understand that AUSISS will not release any Business Proposal content including any trading projections until payment has been received in full.
(d) An Ausiss Membership is available to everyone at the completion of their Business Exploratory Trip. Member benefits include ongoing Ausiss support designed to provide updated information as requested, and to save clients time and money until they return to Australia.
13. No warranties, exclusion of damages, limitation of liability and exclusive remedy. The Content is only for your general information and use and is not intended to address your particular requirements. In particular, the Content does not constitute any form of advice, recommendation or arrangement and is not intended to be relied upon in making (or refraining from making) any specific investment or other decisions. Appropriate independent advice should be obtained before making any such decision. Any arrangements made between you and any third party named on this Site are at your sole risk and responsibility.
14. No warranties
Because of the number of sources from which AUSISS obtains content and the nature of electronic distribution via the internet and mobile telephones (or other portable electronic devices), AUSISS does not give any warranties in respect of the site, content. In particular, the site services are provided on an "as is", "with all faults" and "as available" basis. To the extent allowed by applicable law, AUSISS hereby disclaims all warranties, conditions or duties of every nature whatsoever (except any duties of good faith), including without limitation, any implied warranties of merchantability or of fitness for a particular purpose, any express or statutory warranties, and any warranties or duties regarding accuracy, timeliness, completeness, performance (including down times & server errors), lack of negligence or of workmanlike effort.
Although we will never intentionally include any suspicious files, due to the nature of the internet AUSISS makes no warranty that the site services are free from infection by viruses or anything else that has contaminating or destructive properties.
15. No incidental or consequential damages
To the full extent allowed by applicable law, you agree that AUSISS will not be liable to you and/or any third party for any consequential or incidental damages (including but not limited to lost profits, loss of privacy or for failure to meet any duty including but not limited to any duty of good faith, lack of negligence or of workmanlike effort) or for any other indirect, special, or punitive damages whatsoever that arise out of or are related to the site services or to any breach of these terms by AUSISS, even if AUSISS has been advised of the possibility of such damages and even in the event of fault, tort (including negligence) or strict liability.
16. Limitation on damages; exclusive remedy
You agree that your only recovery for any damages that you incur, and your exclusive remedy, shall be limited to the direct damages you actually incur in reasonable reliance on the applicable site service up to a limit of the following.
(1) a refund of the amount you paid AUSISS (if any) to receive the relevant service in total, less any reasonable allowance for complying services, or
(2) correction or replacement of the service. All limitations will apply to all legal and equitable theories.
17. Links
The Site and its services may from time to time contain links to other World Wide Web or WAP sites provided by independent third parties ("Third Party Sites"), either directly or through frames. Where possible, AUSISS will make clear where such links are being made, though Third Party Sites may be co-branded with AUSISS and so include AUSISS trade mark. AUSISS is not responsible for the availability or content of Third Party Sites and will not be a party to, or in any way responsible for, any transaction concerning goods or services available from such Third Party Sites.
18. Privacy Policy
Your contact details registered in our database may be used to provide updated information and support to you from time to time.
Your personal information will not be shared, rented or sold to any third party. We will not use or disclose your personal information without your consent unless required by law.
19. Changes to these Terms
AUSISS reserves
the right, at its sole discretion, to make changes to any part of the Site and
its related services. Due to its policy of updating and improving the Site,
AUSISS may wish to change these Terms. When Terms are changed, AUSISS will
publish details of those changes by including them at the end of these Terms
(see "Details of Changes"). If you use the Site or related services after AUSISS
has published or notified you of the changes, you are agreeing now to be bound
by those changes. If you do not agree to be bound by those changes, you should
not use the Site (and should cancel your subscription to any related services)
any further after they are published at the end of these Terms or after you
receive notice of them.
20. Advertising and Sponsorship
Part of the Site or related services may contain advertising and sponsorship. Advertisers and
sponsors are responsible for ensuring that material submitted for inclusion on
the Site complies with international and national law. AUSISS will not be
responsible for any error or inaccuracy in advertising or sponsorship material.
21. Choice of Law and Jurisdiction.
This site is governed by the laws of Victoria, Australia.
